Introduction
By creating an account or accessing the Puffin Resilience Lab application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to teachers, principals and administrators, and school boards and districts that procure the Service on behalf of schools. Accounts must be created by adults (18+). Students access the Service through teacher-managed accounts only.
Puffin Resilience Lab is a K–8 Social-Emotional Learning (SEL) tool consisting of:
- Emotional regulation tools: Breathing exercises, body scan activities, mindfulness exercises, and focus-mode tools
- Teacher dashboards: Real-time student mood check-ins, trend reports, wellbeing flags, and class-level wellbeing overview
- Student check-ins: Age-appropriate mood and feeling check-ins conducted under teacher supervision
- Mindful stories and curriculum content: Structured SEL content including lesson plans, breathing exercises, and stories aligned to provincial curriculum outcomes (Ontario HPE expectations)
- Principal dashboard: School-level wellbeing overview, teacher and class management, reporting, and CSV export

The Service is intended as an educational and emotional regulation support tool. It is not a clinical mental health service, diagnostic tool, or substitute for professional counselling or therapy.
👩🏫Teacher Accounts
Teachers are solely responsible for:
- The security of their login credentials
- All activity occurring under their account, including student data they upload or manage
- Ensuring student information is entered accurately and kept up to date
- Maintaining appropriate supervision when students use the Service
🏫Principal / Administrator Accounts
Administrators are responsible for managing teacher accounts, ensuring teachers have been briefed on appropriate student data handling, and all purchasing decisions and billing for their school.

Accounts may not be shared across individuals. Each teacher, principal, or administrator must have their own unique account. Student accounts are created and managed exclusively by teachers.
The Service may only be used for educational and therapeutic support purposes within K–8 school settings.
✔️Permitted Uses
- Using breathing exercises, body scans, and mindful stories as part of classroom SEL programming
- Reviewing student check-in data in the teacher or principal dashboard for educational support purposes
- Creating and managing student accounts within your school
- Exporting wellbeing data for school improvement planning and reporting
✖️Prohibited Uses
- Using the Service to diagnose mental health conditions
- Using the Service as a substitute for clinical therapy or crisis intervention
- Attempting to access data for students not assigned to your account
- Sharing account credentials with unauthorized persons
- Using the Service to collect data for non-educational commercial purposes
- Reverse engineering, scraping, or extracting content from the Service
- Using the Service in any way that violates applicable law or school board policy
Puffin Resilience Lab reserves the right to suspend or terminate accounts that violate these Terms.

Teachers and administrators manage student data. Puffin Resilience Lab does not own student data.
- Student information (names, check-in responses, mood data) is uploaded and managed by teachers and principals
- Puffin Resilience Lab acts as a data processor on behalf of schools and educators; schools act as the data controllers responsible for compliance with applicable privacy legislation (including FIPPA/MFIPPA in Ontario)
- Puffin Resilience Lab will not sell, share, or use student data for commercial purposes, advertising, or profiling
- Student data is retained only while an active school subscription exists, and is deleted within 60 days of account termination unless legally required to retain otherwise
- Schools are responsible for obtaining any necessary parental consents or privacy impact assessments
- In the event of a data breach affecting student data, Puffin Resilience Lab will notify the school administrator within 72 hours of discovery

All content within the Service — including but not limited to breathing exercise audio, body scan scripts, mindful stories, lesson plans, illustrations, animations, and the Puffin Resilience Lab name and logo — is owned by Puffin Resilience Lab and protected by copyright and other intellectual property laws.
- Teachers and schools receive a non-exclusive, non-transferable license to use the Service for educational purposes within their school during the subscription period
- This license does not grant ownership of any content; it does not permit redistribution, resale, or sublicensing
- Content created by teachers within the Service (e.g., custom class names, student groupings) remains the teacher's or school's property
- Modification, redistribution, or commercial use of Puffin Resilience Lab content without written consent is strictly prohibited
Purchases made by schools or school boards may be subject to internal procurement policies. It is the purchasing school's responsibility to ensure:
- The purchase has been properly authorized under applicable board procurement policies
- Any required privacy impact assessment or data-sharing agreement has been completed
- The Service meets school board technology and accessibility requirements
Puffin Resilience Lab will provide documentation (vendor questionnaires, data processing agreements, privacy statements) upon reasonable request. Contact puffinresiliencelab@gmail.com to request documentation.
Subscription details will be confirmed upon payment processing launch. In the meantime:
- Plans are priced per school, with volume pricing available for school boards purchasing on behalf of multiple schools
- Billing cycle is annual, with invoicing issued to the school's designated billing contact
- Auto-renewal: Subscriptions renew automatically unless cancelled in writing at least 30 days before the renewal date
- Cancellation: Schools may cancel by contacting the billing administrator or puffinresiliencelab@gmail.com. Cancellation takes effect at the end of the current term. No refunds for partial terms.
- Price changes: 60 days' written notice before changes take effect at next renewal date
- Payment is the responsibility of the purchasing school unless otherwise agreed in a written contract

Puffin Resilience Lab is an educational emotional regulation tool, not a clinical or therapeutic service. Puffin Resilience Lab is not a licensed mental health provider. The Service is not intended to diagnose, treat, prevent, or cure any mental health condition.
Use of the Service is at the user's and school's own risk. Puffin Resilience Lab makes no representations about the suitability of the Service for any particular student's needs.
- In no event shall Puffin Resilience Lab be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or emotional distress arising from use of or inability to use the Service
- Aggregate liability for any claim shall not exceed the total amount paid by the school in the 12 months preceding the event giving rise to the claim
- Student wellbeing: Teachers and schools remain responsible for ensuring students in distress receive appropriate support, including referral to school counsellors, mental health professionals, or crisis services
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
Before initiating formal proceedings, the parties will attempt in good faith to resolve any dispute through direct negotiation.
- Informal negotiation: Either party may send written notice of a dispute to the other. Both parties will make reasonable efforts to resolve the dispute within 30 days.
- Mediation: If informal negotiation fails, the parties agree to attempt mediation administered by the ADR Institute of Canada before a neutral mediator, with costs shared equally.
- Litigation: If mediation fails, disputes shall be resolved in the courts of Ontario. Class action waivers apply.
Puffin Resilience Lab may update these Terms from time to time to reflect changes in the Service, applicable law, or business operations. Material changes will be communicated by email to the school's billing contact at least 30 days before they take effect.
Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
